1. About these terms
These terms apply to your use of the Waytrax service. By creating an account or using the service, you agree to these terms.
2. Service provider
Waytrax is provided by Restart IT Services Ltd (Company number 14512844), 25 Mccudden Drive, Longhedge, Salisbury, Wiltshire, SP4 6SQ.

3. Data protection and roles
For customer data entered into Waytrax by your organisation, your organisation is normally the data controller and Restart IT Services Ltd is the data processor.
Personal data is stored and processed in the United Kingdom. More detail is in the Privacy Policy.
4. Account responsibilities
- You must provide accurate information and keep it up to date.
- You are responsible for keeping login details secure.
- You must ensure users in your organisation use the platform lawfully.
5. Acceptable use
You must not misuse the service, including by:
- Attempting unauthorised access.
- Uploading unlawful, harmful, or infringing content.
- Interfering with service operation or security.
6. Availability and support
We aim to keep the service available and reliable, but availability is not guaranteed at all times. Planned maintenance and urgent fixes may occasionally affect access.
7. Fees and billing
Paid features are charged according to your selected plan. Unless stated otherwise, fees are due in advance and are non-refundable except where required by law or agreed in writing.
8. Suspension and termination
We may suspend or terminate access if these terms are breached, if payment is overdue, or where required for security or legal reasons. You may stop using the service at any time.
9. Liability
Nothing in these terms limits liability where it cannot be limited by law. Subject to that, our liability is limited to foreseeable losses directly caused by our breach, and we are not liable for indirect or consequential loss.
10. GPS tracking limitations and disclaimer
Waytrax includes GPS-based tracking features. By using these features, you acknowledge and agree to the following:
- Accuracy: GPS location data is inherently approximate. Readings may be affected by terrain, weather, signal interference, device hardware, or other environmental factors and may not reflect the precise real-world position of a person or device.
- Delays: Position updates and alerts may be delayed due to network conditions, satellite availability, or device connectivity. Data shown in Waytrax may not represent the current position of a tracker at any given moment.
- Device availability: Tracking devices may go offline, lose power, or otherwise cease transmitting without warning. The absence of a position update does not mean a participant remains at the last reported location.
- Not a safety system: Waytrax is a data management and event support tool and must not be relied upon as a primary safety, supervision, or emergency response system. Appropriate safety procedures and supervision remain the responsibility of the organising party.
Liability: To the fullest extent permitted by law, Restart IT Services Ltd excludes liability for losses arising from inaccurate, delayed, incomplete, or unavailable GPS tracking data, or from the failure of any tracking device to transmit its position.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded or limited under applicable law.
11. Changes
We may update these terms from time to time. The latest version will be published on this page. Continued use of the service after updates means you accept the updated terms.
12. Governing law
These terms are governed by the laws of England and Wales. Courts of England and Wales have jurisdiction, unless mandatory local law says otherwise.
