For customer data entered into Waytrax by your organisation, your organisation is normally the data controller and Restart IT Services Ltd is the data processor.

We aim to keep the service available and reliable, but availability is not guaranteed at all times. Planned maintenance and urgent fixes may occasionally affect access.

Paid features are charged according to your selected plan. Unless stated otherwise, fees are due in advance and are non-refundable except where required by law or agreed in writing.

8. Suspension and termination

We may suspend or terminate access if these terms are breached, if payment is overdue, or where required for security or legal reasons. You may stop using the service at any time.

9. Liability

Nothing in these terms limits liability where it cannot be limited by law. Subject to that, our liability is limited to foreseeable losses directly caused by our breach, and we are not liable for indirect or consequential loss.

10. GPS tracking limitations and disclaimer

Waytrax includes GPS-based tracking features. By using these features, you acknowledge and agree to the following:

Liability: To the fullest extent permitted by law, Restart IT Services Ltd excludes liability for losses arising from inaccurate, delayed, incomplete, or unavailable GPS tracking data, or from the failure of any tracking device to transmit its position.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded or limited under applicable law.

12. Governing law

These terms are governed by the laws of England and Wales. Courts of England and Wales have jurisdiction, unless mandatory local law says otherwise.
